Alter Ego and Joint Partner Trusts: A Comprehensive Update

Alter ego trusts and joint partner trusts were introduced in 2001 and have become essential wealth and succession planning tools for Canadians 65 and older. However, a comprehensive update incorporating 20+ years of CRA interpretations, case law, and current planning challenges would be valuable.

  • The 65-year age requirement and rollover mechanics under the Income Tax Act
  • Subsection 75(2) reversionary trust rule concerns and how to avoid them​
  • Loss of LCGE eligibility (unlike spousal trusts)​
  • Interaction with the 21-year rule (these trusts are exempted until the settlor's death, then the 21-year clock starts)​
  • Provincial probate savings analysis across provinces
  • Family law considerations and potential fraudulent conveyance issues
