Does my client have capacity to sell real estate?  Are there any concerns about undue influence?  Join our virtual interactive workshop to learn more about next steps. Realtors owe a duty of care, and this includes ensuring that their clients have the mental capacity to enter into a contract.


The general principle is that in order to enter into an enforceable contract, a person must have the mental capacity to do so. The goal of this rule is to ensure that a person is capable of understanding the contract terms and appreciating that they are committing to certain legally binding obligations.
We will review professional rules related to vulnerability and mental capacity.  Then we will go through two case studies to review and analyze the process using online and offline tools.

Presenters: Nathan Spaling, RSSW, BA (Hons), JD

As a Registered Social Service Worker and Lawyer, Nathan has a unique experience working with people who live with (or are living through) vulnerable conditions or situations. However, during his time as a lawyer at a well-respected law firm operating out of the Waterloo, Wellington and Halton regions, he recognized that most industries do not have access to resources/training that allow for identification, analyzing and reporting on risks of incapacity and/or undue influence. 

In response to this, Nathan founded the Capacity Clinic and POA Registry to bring together resources from multidisciplinary leaders within the capacity evaluation area in order to reduce the barriers that vulnerable Decision Makers face when accessing services.
